[1]By a letter dated 4 March 2024 the Tribunal gave the respondent an opportunity to make representations or to request a hearing, as to why the response should not be struck out becausea. the respondent had failed to comply with case management orders made on 14 December 2024, orders numbered 3 and 4 therein; andb. the response has not been actively pursued.[2]The respondent has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The response is therefore struck out.[3]The claim shall now be listed for final hearing, of which a separate notice shall follow. _____________________________ Employment Judge Batten 8 April 2024[1]The claim of unauthorised deductions from pay in respect of holiday pay is well-founded. The respondent is ordered to pay the claimant the gross sum of £628.16 for holidays accrued but untaken when employment terminated.[2]This sum is increased by two weeks’ pay in the sum of £572 because of a breach by the respondent of the duty to provide a written statement of the main terms of employment.[3]The total sum payable by the respondent to the claimant is £1,200.16.
