Mr C McGann v Nobles Constructions Ltd: 2407390/2021
JUDGMENT
The claim is struck out.REASONS
[1]The claim has been brought against a respondent that is in administration. By letter dated 27 July 2021 the claimant was informed that a claim against a respondent in administration cannot be pursued without the consent of the Administrator or the permission of the court.[2]The claim was stayed to allow the claimant to seek permission to proceed. The stay was stated to be for six months. The claimant did not confirm to the Tribunal whether permission had been sought during, or upon expiry of, the stay.[3]The claimant was informed by letter dated 5 April 2022 that it was proposed that his claim would be struck out. This was on the basis that the claim was not being actively pursued. The claimant was given 14 days to give to make representations in writing why this should not be done or to request a hearing to hear his representations.[4]The claimant has failed to make representations in writing why this should not be done or to request a hearing. The claim is therefore struck out.
