JUDGMENT
[1]The respondent made unlawful deductions in respect of each of the claimants’ wages.[2]The claims of claimants(1) (2) and(3) in respect of unlawful deduction of wages are well founded and succeed.[3]The first and second claimants are entitled to payment in lieu of holiday accrued but not taken at the date of termination of their employment and their claims in this respect succeed.[4]The claim of the first claimant for breach of contract in respect of expenses incurred and not re-imbursed on the termination of her employment is well founded and succeeds.[5]The claim of the third claimant in respect of breach of contract (notice pay) is well founded and succeeds.[6]The Respondent is ordered to pay the following amounts to:[7]Ms P Read (Claimant (1) Case No:2407339.23), the total sum of £1158.37 made up of the following:a. The sum of five hundred and ninety eight pounds (£598) in respect of unlawful deduction of wagesb. The sum of three hundred and twelve pounds in respect of payment in lieu of holiday accrued under the Working Time Regulations but not taken at the end of the claimant’s employmentc. The sum of two hundred and forty seven pounds and fifty seven pence as damages for breach of contract (failure to pay expenses) (the claimant to be responsible for accounting to HMRC in respect of any employee liability arising in respect of NIC or income tax)[8]Ms S Thomas (Claimant (2) Case No:2409108/2023), the total sum of £1042.62, made up of the following:a. The sum of six hundred and forty pounds (£640), in respect of unlawful deduction of wagesb. The sum of four hundred and two pounds sixty two pence (£402.62), in respect of payment in lieu of holiday accrued under the Working Time Regulations but not taken at the end of the claimant’s employment (the claimant to be responsible for accounting to HMRC in respect of any employee liability arising in respect of NIC or income tax)[9]Mrs P Stockwell (Claimant 3) Case No:2409282/2023), the total sum of £3220.45, made up of the following:a. The sum of one thousand eight hundred and eighty six pounds sixty nine pence (£1886.69), in respect of unlawful deduction of wagesb. The sum of one thousand three hundred and thirty three pounds seventy six pence as damages for breach of contract (notice pay) (the claimant to be responsible for accounting to HMRC in respect of any employee liability arising in respect of NIC or income tax)
