JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has failed to present a valid response on time. The employment judge has decided that a determination can properly be made of the claim, in accordance with Rule 21 of the Rules of Procedure.[2]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant in the gross sum of £3,276.[3]The claimant was dismissed by reason of redundancy and is entitled to a redundancy payment of £4,914.[4]The respondent has failed to pay the claimant’s accrued annual leave entitlement of 21 days and is ordered to pay the claimant the gross sum of £1,965.[5]The Claimant’s claim of unfair dismissal succeeds.[6]No basic award for unfair dismissal is made because the claimant is awarded the redundancy payment.[7]A compensatory award for unfair dismissal is made of £250 for loss of statutory rights (no other losses having been identified)[8]The hearing listed on 31 January 2023 is cancelled.
