JUDGMENT
Noting that(a) By a reserved judgment promulgated on 16 May 2016 the tribunal found that the claimant had been unfairly dismissed;(b) By a judgment on remedy promulgated on 12 December 2016 the Tribunal determined that no order for reinstatement or re-engagement would be made, determined the basic award for unfair dismissal, and made findings as to the basis upon which the compensatory award would be determined;(c) By Notice of Appeal acknowledged by the Employment Appeal Tribunal on 30 January 2017 and allocated appeal reference UKEATPA/0045/17/LA the claimant appealed against the judgment on remedy promulgated on 12 December 2016;(d) without prejudice to the pending appeal the claimant has agreed with the respondent that he will accept £24,441.87 as the amount due to him were the tribunal to make a compensatory award, and that Case No. 2407072/2015(e) the respondent has consented to these proceedings being dismissed on this basis, and the claimant has not raised any objection within the time allowed for him to do so, the unanimous judgment of the tribunal is that all further proceedings as to remedy are dismissed unless the Tribunal’s judgment as to remedy is disturbed on appeal.
