JUDGMENT

The claimant’s complaint of unauthorised deduction from wages under Section 23 and 13 Employment Rights Act 1996 is struck out under Rule 37 (1)(a) Employment Tribunal (Constitution and Rules of Procedure) Regulations 2013 of the Tribunal’s own volition on the grounds that it has no reasonable prospect of success. The respondent had failed to file a Response in time and had sent a late response without an application for an extention of time. The response was not accepted. The respondent, who did not attend, would have only been permitted to participate in any final hearing, if the claim had not been struck out, to the extent permitted by an employment judge hearing the claim. This brings her claim to an end.
