Employment Judge FraneyDate 27 February 2025

JUDGMENT

The complaint in respect of a redundancy payment is struck out.

REASONS

[1]By a letter dated 4 December 2024 the Tribunal gave the claimant an opportunity to make representations, or to request a hearing at which to do so, as to why the claim for a redundancy payment should not be struck out because it had no reasonable prospect of success. It had no reasonable prospect of success because the claimant had not been employed for two complete years at the date employment terminated and the right to a redundancy payment did not arise.[2]The claimant has not made any representations or requested a hearing.[3]The claim for a redundancy payment is therefore struck out under Rule 38(1)(a).[4]The claimant’s remaining claims will be considered at a case management hearing on 11 September 2025.
