JUDGMENT

[1]The complaint of unauthorised deduction from wages is well-founded and the second respondent is ordered to pay to the claimant the sum of £158.67 forthwith.[2]The sum of £158.67 comprises £39.67 (£79 less £39.33 paid by the respondent since these proceedings were instituted) in respect of an underpayment of wages and the sum of £119 in respect of unauthorised deductions from the final pay of the claimant. The said sum of £39.67 is a gross payment and the claimant is to pay over to the appropriate authorities any income tax and employee national insurance contributions due in respect of such sum.[3]The complaint of unauthorised deduction from wages against the first respondent is dismissed on withdrawal by the claimant.
