Employment Judge TobinDate 6 March 2024

JUDGMENT

The response is struck out.

REASONS

[1]By the order dated 16/11/2023 the Tribunal gave the respondent an opportunity to make representations or to request a hearing, as to why the response should not be struck out because: the respondent had not attended the preliminary hearing listed on 16/11/2023, and failed to provide reasons why or objections to the response being struck out within seven days. it has not been actively pursued.[2]The respondent has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The response is therefore struck out.[3]The respondent will be entitled to notice of any hearings and decisions of the Tribunal but will only be entitled to participate in any hearing to the extent permitted by the Employment Judge.[1]The claimant was dismissed by reason of redundancy and is entitled to a redundancy payment of £1,676.00 (aged between 22 and 41 = 1 week’s gross pay @ £419 for each full year worked x 4 years).[2]Consequently, the respondent must pay the claimant the total gross sum of £1,676.00 within 14 days of the date of this judgment.
