The claim is struck out.

REASONS

[1]Rule 37 of the Employment Tribunal Rules of Procedure 2013 gives the tribunal the power to strike out a claim if it has not been actively pursued.[2]A preliminary hearing took place on 12 September 2023. The claimant did not attend.[3]By letter dated 12 September 2023, the tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out for failure to pursue it actively.[4]In a case management order sent to the parties on 2 October 2023, the parties were reminded that the claim would be struck out if the claimant did not respond to the tribunal’s letter.[5]The claimant has failed to make representations in writing or to request a hearing.[6]The claim is therefore struck out.
