Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has failed to present a valid response on time. The Employment Judge has decided that a determination can properly be made of the claim, in accordance with rule 21 of the Rules of Procedure.[2]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the sum of £3,136.32 (£356.40 per week divided by 5 = £71.28 per day; £71.28 x 44 days = £3,136.32. This is for 5 days for October 2021 Half Term, 10 days for December 2021 Winter Break, 5 days for February 2022 Half Term break and 24 days for April 2022 Holidays; 5 + 10 + 5 + 24 = 44 days’ holiday.) This is a gross sum and the claimant must account to HMRC for any tax and national insurance due upon it.[3]The hearing listed on 16th November 2022 is cancelled.
