The claim is struck out.REASONS
[1]Rule 37 of the Employment Tribunal Rules of Procedure 2013 give tribunals the power to strike out a claim that has not been actively pursued.[2]By letter dated 15 January 2020, the claimant was warned that his claim might be struck out. The grounds for proposing to strike out the claim were: 2.1. that the claimant had not complied with a request to provide an ACAS certificate number; and 2.2. that the claim was not being actively pursued, in that the claimant had not attended a hearing on 10 October 2019 and had not responded to correspondence from the tribunal.[3]The claimant was given until 22 January 2020 to make representations in writing or to request a hearing. No representations or request has been received.[4]The claim is therefore struck out. Case No: 2406341/2019[5]In any event the tribunal would have been required to reject the claim under rule 12 of the 2013 Rules. This is because the claim form did not contain an ACAS certificate number.
