JUDGMENT
[1]The claimant’s claim for unlawful deduction of wages is conceded by the respondent in the sum of £93.96p[2]The sum of £93.96p was unlawfully deducted from the claimant’s wages and the claim succeeds.[3]The respondent shall pay to the claimant the sum of £93.96p as compensation for the sum unlawfully deducted (the claimant shall be responsible for any employee liability to tax on this amount)[4]The respondent’s disciplinary and grievance procedure were not contractual and the claimant’s claim for breach of contract (failure to follow the company disciplinary and grievance procedure) is not well founded and is dismissed.[5]The claimant’s claim that his was automatically dismissed under s99 Employment Rights Act 1996 (ERA 1996) by reason of him exercising rights under s57A ERA 1996, is not well founded and is dismissed.[6]The respondent was entitled to dismiss the claimant without notice or payment in lieu of notice and his claim of wrongful dismissal is not well founded and is dismissed.
