JUDGMENT
Upon hearing from the claimant and the respondent, the judgment of the Tribunal is that: -[1]the claim about a failure to provide employee liability information, pursuant to regulation 11 of the Transfer of Undertakings (Protection of Employment) Regulations 2006, was presented to the Tribunal in circumstances where the Tribunal was satisfied(a) that it was not reasonably practicable to present the claim before the end of the period of 3 months beginning with the date of the relevant transfer, and(b) that the claim was presented in such further period as the Tribunal considers reasonable;[2]accordingly, the claim shall proceed and, by consent of the parties, it shall be linked to case number 2403564/2020. The claim shall be listed for hearing on a date at least one month after the date of the final hearing in case number 2403564/2020; and Case No. 2406159/2020 CODE A[3]the final hearing of the claim which is listed for 8 January 2021 shall be cancelled.
