JUDGMENT

[1]The claimant presented his claim of race discrimination out of time in circumstances where it would be just and equitable to extend time to the date of actual presentation; the tribunal has jurisdiction to hear the claim;[2]The tribunal cannot say, without hearing evidence that was not adduced today, that the claimant’s claims have no, or little, reasonable prospect of success. The respondents’ application for an Order striking out the claim or alternatively for payment of a deposit by the claimant are dismissed.[3]The respondents’ joint application for a Costs Order is postponed to be heard after the final hearing if pursued by the respondents or either of them, the onus being on them to re-apply failing which it will be dismissed upon deemed withdrawal 29 days after the date on which the finally determinative judgment is sent to the parties.
