JUDGMENT

The claim is struck out.

REASONS

[1]By a letter dated 15 April 2021 the Tribunal gave the claimants an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because  They have failed to comply with the directions of Employment Judge Howard sent to them on 24 November 2020 to provide fully particularised schedule of loss so that judgement could be issued without the need for a hearing.  They have failed to respond to a previous strike out warning issued by Employment Judge Aspinall on 26 January 2021. That warning wrongly named only Speke Care Homes as respondent and the claimant should be in no doubt that the Tribunal proposed striking out their claims against all the respondents named above and that strike out means an end to their tribunal claims.  It would appear from the failure to respond to the directions and warning above, and from failures to respond to correspondence in 2020, that the claims are not being actively pursued.[2]The claimants have failed to make representations in writing, or have failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.
