JUDGMENT

The claimant’s claim of unlawful deduction from wages, brought pursuant to the provisions of Part II of the Employment Rights Act 1996, succeeds. The respondent failed to provide the claimant with a written statement of employment particulars. The Tribunal makes a higher award of 4 weeks’ pay, it being just and equitable in all the circumstances to do so, pursuant to S38 Employment Act 2002. The respondent is ordered to pay to the claimant £10,304.00 consisting of the following: Unlawful deduction from wages: 52 weeks (11th February 203312th February 2024 @ £184.00 per week): £9,568.00 Failure to provide written statement of employment particulars: 4 weeks @ £184.00: £736.00
