EMPLOYMENT TRIBUNALS
Case No 2405858/2023
Mr P O’BrienClaimantLancashire County CouncilRespondent
Employment Judge Phil AllenIn person for claimantMr D Jones (instructed by counsel) for respondentDate 1 October 2024

JUDGMENT

[1]The claims for sex discrimination and harassment related to sex were not presented within the applicable time limit. It is not just and equitable to extend the time limit. The claims for sex discrimination and harassment related to sex are therefore dismissed.[2]The application to strike out the claim under rules 37(1)(b), (c) and (d) did not succeed and the claim for unfair dismissal was not struck out.[3]The application by the respondent that the claimant be ordered to pay its costs from the hearings of 8 December 2023 and 21 May 2024 did not succeed. Employment Judge Phil Allen 15 August 2024

REASONS

[1]The claimant was ordered to pay a deposit of £300 following a preliminary hearing held on 15 August 2024. The Order was sent to the claimant on 19 August 2024. The claimant has failed to pay this deposit. The complaint of unfair dismissal is therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[2]The hearing fixed for 10-12 December 2024 will not take place.
