JUDGMENT
[1]The following complaints are struck out:a. The complaint of discrimination arising from disability as set out at 7.2.4 of the list of issues included as an appendix to the case management order made following the hearing on 15 February 2024 (3.2.2 in the list of issues at annex two to the case management order made following the hearing on 23 April 2024); andb. The complaint of breach of the duty to make reasonable adjustments set out at 8.2.1 and 8.5.1 of the list of issues included as an appendix to the case management order made following the hearing on 15 February 2024 (4.2.1 and 4.5.1 in the list of issues at annex two to the case management order made following the hearing on 23 April 2024).REASONS
[1]The claimant was ordered to pay a deposit of £500 for each of the above allegations following a preliminary hearing held on 23 April 2024. The Order was sent to the claimant on 13 May 2024.The claimant has failed to pay either of these deposits. The complaints listed above are therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[2]The remaining claims will be heard at the final hearing fixed for 3-5 September 2024.
