The claims are struck out.REASONS
[1]By a letter dated 14 September 2024 an employment judge made a number of case management orders, including proposing to amend the name of the respondent to Forb Cross Limited, formerly Hearth of the Ram Limited. Any cogent objection must have been made by either party within 7 days of the date of this letter. There were no cogent objections and the respondent’s name was changed to Forb Cross Limited. Companies House confirms the name was changed on 8 May 2023, on the 20 May 2024 Forb Cross Limited was dissolved and no longer exists as a limited company. In order to sue the respondent it must be restored to the register of companies and this has not happened. The claims are therefore struck out.[2]In the alternative, had the respondent not been dissolved the claims would also have been struck out following the strike out warning made on the 30 January 2024 and sent to the parties on the 5 February 2025. The claimants did not comply with the case management orders made on the 14 September 2024 and unless order was made when they failed to attend a final hearing Case Number: 2405645/2023 2405646/2023 (for the second time) on the 30 January 2025. The claimants did not comply and nor did they appear at today’s hearing. The claimants have not complied with the Orders of the Tribunal that were sent to the parties under cover of letter 14 September 2023 and the claims have not been actively pursued. The claims are therefore struck out.
