JUDGMENT

[1]The claimant of unfair dismissal is well founded and succeeds. The respondent is ordered to pay the claimant £25,679.25 consisting of:a. £1,713 basic awardb. £23, 966.25 (£19,173 uplifted by 25% by way of ACAS Uplift).[2]The claimant’s complaint of unauthorised deduction from wages/breach of contract in respect of commission and expenses is well founded. The claimant is awarded compensation in the sum of £2,335.46 (£1,868.37 uplifted by 25% by way of ACAS Uplift)a. £832.07 benefit due under clause 7 of the statement of terms and conditions.b. £830.30 unpaid fuel expenses.c. £206 sundries.[3]The total amount of the above awards due to the claimant is £28,014.71[4]In accordance with rule 39(5)(b) the tribunal having decided each of the specific arguments against the respondent for substantially the same reasons as given in the deposit order the deposit shall be paid to the claimant.
