Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant in the sum of £2,119.28.[2]The claimant was unfairly dismissed and is entitled to a basic award of £2,706 and a compensatory award of £8,212,21. The claimant is awarded £450 for loss of statutory rights. An uplift of 25% is awarded in respect of the compensatory award of £2,053.05 for failure to follow the ACAS Code of Practice. Accordingly the claimant is awarded a total of £13,415.26. The recoupment regulations apply: Monetary Award £13415.26 Amount of the prescribed element £8212.21 Dates of the period to which the 29th July 2016 to 3rd March 2017 prescribed element is attributable Amount by which the monetary award £5203.04 exceeds the prescribed element[3]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the sum of £1,059.64.[4]The claimant’s claim of disability discrimination is stayed for eight weeks.
