JUDGMENT
[1]Upon the failure of the claimant to attend the hearing today and upon the failure of the claimant to comply with the Order of Employment Judge Ross of 5 July 2018 in relation to exchange of witness statements, the claimant’s claim for wrongful dismissal and the claimant’s claim for commission payments are dismissed.[2]In these circumstances only, the respondent withdraws their counter claim although if the claimant’s claim is subject to any further action the respondent reserves the right to raise the matter again.[3]No order is made today in relation to the respondent’s application for costs but the respondent reserves its permission in accordance with the Employment Tribunals (Rules of Procedure Regulations) 2013 to pursue a costs application against the claimant.
