JUDGMENT
The JUDGMENT of the tribunal is that:-(1) The respondents have made a series of unlawful deductions from the claimant’s pay contrary to section 23 of the Employment Rights Act 1996 (“the Act”) in respect of work undertaken by the claimant between 14 August 2017 and 21 August 2017 in the total sum of £359.55 gross (51 hours x £7.05 per hour). The respondents have paid the claimant the sum of £260.90 in respect of such monies and the respondents are therefore ordered to pay to the claimant the balance of £152.65 gross.(2) The respondents have failed to issue the claimant with a statement of particulars of employment as required by section 1 of the Act and the respondents are therefore ordered to pay to the claimant a further sum of £648.60 (2 weeks’ gross salary at Case no 2405376.2017 £324 .30 per week) pursuant to section 38 of the Employment Act 2002.(3) The total sum which the respondents are ordered to pay to the claimant is therefore £801.25 gross.
