Miss D Olbinson and others v The Chief Constable of Greater Manchester Police: 2405350/2022 and others
JUDGMENT
[1]The claims of the second and third claimants (Miss Mason and Miss Ridley-Laing) are dismissed upon withdrawal. They are removed from these proceedings.[2]The claim of the fifth respondent, Miss Iqbal, is struck out. She is also removed from the proceedings.REASONS
[3]At a preliminary hearing on 28 March 2023, Miss Ridley-Laing confirmed that she was content to be removed from these proceedings, as she had been named in error as an additional claimant by the lead claimant, Miss Olbinson. Miss Ridley-Laing also confirmed that she was authorised to speak on behalf of Miss Mason, who adopted the same position. I have therefore dismissed both of those claims on withdrawal. For the avoidance of doubt, both Miss Mason and Miss Ridley-Laing have other, separate, claims which will proceed.[4]Miss Iqbal did not attend the preliminary hearing and had not been in communication with the other claimants, or the Tribunal, regarding the claim made on her behalf by Miss Olbinson. By letter dated 4 April 2023, posted to her home address, the Tribunal invited Miss Iqbal to confirm if she was Case No:2405350/2022 2405351/2022 2405352/2022 2405353/2022 2405354/2022 content to be removed from the proceedings and, required her, if she wished to continue with her claim to provide contact information. No response has been received to that letter.[5]In the circumstances, I consider it appropriate to strike out the claim in Miss Iqbal’s name, on the grounds that it is not being actively pursued, and to remove her from the proceedings.[6]The claims of Miss Olbinson and Mr Mather continue and will proceed to further hearings on dates already notified to the parties.
