JUDGMENT
Upon the respondent’s application that the claimant’s claim be struck out under rule 37(1) (c) of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 (the Rules) for non-compliance with the Rules, or alternatively for a reconsideration in accordance with rules 70-72 of the Rules of the decision to accept the claimant's claim, the judgment of the Tribunal is that:[1]The claimant failed to comply with the Rules upon presenting her claim to the Tribunal and the claim is struck out for non-compliance; the Tribunal upon reconsideration of the decision to accept the claim revokes that acceptance and rejects it.[2]Upon consideration of the claimant’s application to reconsider the judgment above on the basis that it was not reasonably practicable for her to comply with the Rules until today and for an extension of time for the presentation of the claim, the Tribunal adjudges that any claim from the claimant now would be out of time in circumstances when it was reasonably practicable for the claim to be presented within three months of the matters of which she complains. Case No. 2405159/2016[3]The claimant's claims of unfair dismissal and that the respondent made unauthorised deductions from her wages are rejected.
