JUDGMENT

The claimant’s claims are dismissed pursuant to Rule 47 of the Employment Tribunals Rules of Procedure 2013.

REASONS

When the case was called the claimant was not in attendance. A notice of hearing was sent to the claimant who has not informed the tribunal that he was unable to attend the hearing. No reason has been given for the claimant's failure to attend. No communication has been received from the claimant. Attempts were made on the morning of the hearing to contact the claimant and were unsuccessful. The respondents’ representatives confirmed they had not had any contact with the claimant since before the last hearing was postponed, on the Tribunal’s own initiative, on 27 November 2017. The claimant’s claims related to the payment of holiday pay. The exact basis of the claims were not clear from the claimant’s ET1. In the absence of any further Case No. 2405146/2017 substantive information from the claimant regarding his claims and the basis for them, taking into account that the claimant bears the burden of proof in these matters, the claimant’s claims were dismissed.
