The unanimous judgment of the Tribunal is as follows:[1]The complaint of unfair dismissal is well founded. The claimant was unfairly dismissed.[2]The claimant was not a disabled person in February 2022 by reason of anxiety and depression.[3]The complaint of discrimination arising from disability in relation to the dismissal of the claimant fails and is dismissed.[4]As remedy for unfair dismissal the Tribunal makes a basic award in the sum of £2,716.25. No compensatory award is made. The recoupment regulations do not apply.
