JUDGMENT
[1]The claimant’s claim is struck out pursuant to rule 37(1)(c) and rule 37(1)(d) Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 because:(1) The claimant has failed to comply with the Case Management Orders of Employment Judge Phil Allen at paragraphs 2.1.1, 2.1.2 and 3.1-3.12 made at a case management hearing which the claimant failed to attend on 26 August 2022. The orders were sent to the claimant on 31 August 2022.(2) The claim has not been actively pursued pursuant as the claimant failed to attend the case management hearing on 26 August 2022, and despite being ordered to explain his non-attendance failed to do so and failed to attend the listed hearing today on 15 November 2022, without explanation. Case No. 2404783/2022[2]The hearing listed on 22, 23 and 24 February 2023 before an Employment Judge sitting with two non-legal members at Manchester Employment Tribunal has been cancelled and will not take place.
