REASONS
[1]The respondent company is in compulsory liquidation. The permission of the court has not been obtained for these proceedings to be instituted or continued as required by the Insolvency Act 1986.[2]On 24 November 2023 the Tribunal gave the claimant an opportunity to provide the Tribunal with evidence by the end of January 2024 that he had obtained or asked for the permission of the winding up court to continue with the Tribunal proceedings, warning the claimant that if he did not do so, his claim would be struck out as it had not been actively pursued. The claimant has not replied to this letter and has not provided the evidence requested.[3]The claim is therefore struck out as not having been actively pursued.
