Mrs B Hodgkiss v Blackpool Teaching Hospitals NHS Foundation Trust: 2404615/2024
JUDGMENT
[1]The Employment Tribunal does not have jurisdiction to hear the claim for unfair dismissal as it was not presented within the applicable time limit. It was reasonably practicable to do so. The claim of unfair dismissal is dismissed.[2]The Employment Tribunal does not have jurisdiction to hear one of the complaints of breach of the duty to make reasonable adjustments as it was not presented within the applicable time limit. It is not just and equitable to extend the time limit. The complaint that the respondent breached its duty to make reasonable adjustments following the report in March 2023 (until late 2023) because the claimant says she should not have been required to work on the furthest wards or on reception, is dismissed.[3]The claimant’s other complaints of breach of the duty to make reasonable adjustments and her complaint of discrimination arising from disability were not presented within the applicable time limit, but it is just and equitable to extend the time limit. Those complaints will therefore proceed. Employment Judge Phil Allen 14 February 2025
