JUDGMENT

The complaint of unfair dismissal is struck out.

REASONS

[1]By a letter dated 8th March 2018 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the complaint of unfair dismissal should not be struck out because under section 108 of the Employments Right Act 1996, claimants are not entitled to bring a complaint of unfair dismissal unless they were employed for two years or more, except in certain specific circumstances.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The complaint of unfair dismissal is therefore struck out.[3]The claimant’s remaining claims remain listed for hearing on 1st August 2018. Regional Employment Judge Parkin 23 July 2018[1]The respondent failed to pay the claimant his accrued holiday pay. The respondent is ordered to pay the claimant the sum of £538.00.[2]The respondent was in breach of contract by terminating the claimant’s employment without giving one weeks statutory notice. The respondent is ordered to pay the claimant the sum of £429.00[3]The respondent is ordered to pay the claimant the total sum of £967.00. Case No. 2404441/2018 2
