Mr A Hind v A P Burt & Sons Ltd (In Creditors Voluntary Liquidation): 2404347/2017
JUDGMENT
The claim is struck out.REASONS
[1]By a letter dated 29 December 2020 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because: it has not been actively pursued.[2]On 3 October 2020, the Tribunal asked the claimant to confirm his position in relation to his claim by12 October 2020. The Claimant did not respond to the letter. On 24 November 2020, Employment Judge Bax reminded the Claimant to comply with the direction in the letter of 3 October 2020, by return. The Claimant did not respond. The Claimant was sent a letter dated 29 December 2020, warning him that consideration was being given to striking out his claim and that if he wanted to object or request a hearing he should do so by 8 January 2021.[3]The Claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.
