JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21 The first respondent, through its Administrators’ letter of 3 October 2016 having stated that it consents to the claim proceeding, and no response having been received from the first respondent to the claim, IT IS THE JUDGMENT OF THE TRIBUNAL THAT:[1]The first respondent failed to comply with the requirements of s.188 or s.188A of the Trade Union & Labour Relations (Consolidation) Act 1992.[2]The claimants are each entitled to a protective award. The protected period for the purposes of the award is 90 days from 8 July 2016, when the first dismissal took effect, and each claimant is entitled to be paid remuneration in respect of this period.[3]The first respondent is ordered to pay the said remuneration to the claimants, together with tribunal fees of £1000.00.[4]No award is made against the second respondent.
