JUDGMENT
[1]The claimant was unfairly dismissed by the respondent. The claimant is awarded a basic award of £1,360 and a compensatory award of £2,804.32. The recoupment provisions do not apply.[2]The respondent has breached the claimant's contract of employment by failing to pay the holiday pay to which she is entitled. The Respondent is ordered to pay the claimant the sum of £1,236.02 net ((£1428 gross) in respect of 21 days’ holiday accrued during the claimant’s maternity leave.[3]The respondent has breached the claimant's contract of employment by failing to pay her notice pay. The respondent is ordered to pay the claimant the sum of £1,177.16 net (£1360 gross) as a payment in lieu of notice.
