In circumstances where the claimant, who is presently imprisoned and/or his representatives were on ample notice of this public preliminary hearing to consider an application for either strike out or deposit order to be followed by a private case management preliminary hearing and had failed to engage in any shape or form with the Tribunal or the respondent since the hearing's listing on 28 October 2019 his claim is on the application of the respondent struck out under Rule 37(1) (d) of the Employment Tribunals (Constitution & Rules of Procedure) Regulations 2013 on the ground that it has not been actively pursued.
