JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent dismissed the claimant in breach of contract and is ordered to pay the claimant damages for breach of contract in the sum of £3,602.07. This is a net sum but has been calculated using gross pay to reflect the likelihood that the claimant will have to pay tax on this sum as “Post Employment Notice Pay”.[2]The complaint of unauthorised deductions from pay is well founded. The respondent is ordered to pay the claimant the gross sum of £1,600.95.[3]The unfair dismissal complaint is well founded. The claimant was unfairly dismissed. The respondent is ordered to pay to the claimant a basic award of £5,403.20 and a compensatory award of £3,373.93 making a total award for unfair dismissal of £8,777.13.[4]The recoupment regulations apply to the unfair dismissal award. The prescribed element relates to the period from 27 January 2020 to 25 March 2020. The prescribed element is £3,373.93. The total monetary award under this judgment is £13,980.15. The amount by which the total monetary award exceeds the prescribed element is £10,606.22.
