JUDGMENT
[1]The claims of the claimants listed in the attached schedule have been withdrawn and their proceedings before the Employment Tribunal cease.[2]The claims are not dismissed under Rule 52 of the Employment Tribunal Rules of Procedure 2013. _________________________________________ Employment Judge Tom Ryan 14 February 2017[1]The parties having settled the claimant’s claims in accordance with a memorandum of their own making, the proceedings are stayed pending implementation of the settlement terms.[2]Unless either party applies to the tribunal in writing for the matter to be reinstated by no later than 4 p.m. on 6th August 2018 the claims will be dismissed on deemed withdrawal by the claimant without further hearing.[3]The tribunal will not lift the stay and restore the hearing if the issue at that point between the parties is one of enforcement of a binding agreement as the tribunal would not have jurisdiction.[4]The tribunal did not hear evidence or make an Award; the recoupment provisions do not apply.
