JUDGMENT
[1]The claimant succeeds in the following complaints:-a. Unfair dismissal.b. Complaints of discrimination contrary to section 18 Equality Act 2010 (pregnancy and maternity discrimination) against the first and third respondent, as follows:- i. Failing to carry out a pregnancy risk assessment ii. Cancelling an intended occupational health appointment iii. Dismissing the claimant.c. Complaints of detriment due to pregnancy contrary to section 47(C) Employment Rights Act 1996 against the first as follows: i. Failing to carry out a pregnancy risk assessment ii. Cancelling an intended occupational health appointmentd. Complaint of victimisation against the first and second respondents, Case Number: 2403595/2024 and 2404655/2024 contrary to section 27 Equality Act 2010 in refusing annual leave on 30 December 2024.[2]The following complaints fail and are dismissed: -a. All complaints of Direct discrimination (protected characteristic race).b. All complaints of Direct discrimination (protected characteristic, religion).c. All complaints of harassment (protected characteristic race).d. All complaints of harassment (protected characteristic religion).e. Complaints of victimisation (other than the one complaint under 1.d above).f. Automatic unfair dismissal contrary to section 99(3)(a) Employment Rights Act 1996 and Regulation 20(1) Maternity and Parental Leave etc Regulations 1999.[3]Remedy will be considered and determined at a hearing on 16 and 17 July 2026.
