JUDGMENT
Employment Tribunals Rules of Procedure 2024 – Rule 22[1]The complaint of breach of contract in relation to notice pay is well-founded. The respondents shall pay the claimant £541.83 as damages for the breach of contract. This figure has been calculated using gross pay to reflect the likelihood that the claimant will have to pay tax on it as Post Employment Notice Pay.[2]The claimant was dismissed by reason of redundancy and is entitled to a redundancy payment of £812.75. The respondents are ordered to pay this to the claimant.[3]The complaint in respect of holiday pay is well-founded. The respondents made an unauthorised deduction from the claimant’s wages by failing to pay the claimant for holidays accrued but not taken on the date the claimant’s employment ended. The respondents shall pay the claimant £180.61. The claimant is responsible for paying any tax or National insurance.[4]The total amount payable by the respondents to the claimant under this judgment is £1,535.19.[5]The respondents are jointly and severally liable to the claimant for this amount.[6]The hearing listed on 7 February 2025 is cancelled.
