JUDGMENT

[1]The complaint of detriment under S.146(1)(b) of Trade Union and Labour Relations (Consolidation) Act 1992 is well-founded. The claimant was subjected to a detriment as an individual by the respondent by failing to pay contractual sick pay for the main purpose of preventing or deterring the claimant from taking part in the activities of an independent trade union at an appropriate time or penalising him for doing so. The respondent is ordered to pay the claimant just and equitable compensation in the gross sum of £2,789.70 which is contractual sick pay.[2]The complaint of unauthorised deductions from pay contrary to Part II Employment Rights Act 1996 is well-founded. The respondent made an unauthorised deduction from the claimant's pay in respect of the period 1 December 2022 to 31 January 2023. There is no award made as the amount claimed is the same as that awarded for the detriment claim.
