Mr J R Ribeiro v Cibo Ltd (dissolved): 2403435/2022
JUDGMENT
The claim is struck out.REASONS
[1]By a letter dated 26 June 2024 the Tribunal gave the claimant an opportunity to make representations or to request a hearing as to why their claim should not be struck out because:• it has not been actively pursued.[2]On the 4 April 2024 the respondent was dissolved, and it no longer legally exists. This means that unless the claimant takes steps to achieve restoration of the name of the company to the register of companies, a claim cannot be brought against it.[3]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. Their claim in its entirety is therefore struck out.
