REASONS

[1]By a letter dated 14 November 2023, the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because: you have not complied with the Order of the Tribunal dated 8 August 2023 and the strike out warning dated 14 November 2023 The final hearing is listed for 3-days commencing 21 February 2024, the claimant has disregarded and failed to comply with the case management orders made on the 6 February 2023 sent to the parties on the 12 January 2023 with the result that the case is not ready for trial, there is insufficient time for the case management orders to be met, a fair hearing cannot take place and if adjourned, it is likely the case will be listed in 2025. It has not been actively pursued.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out. 8 December 2023
