JUDGMENT

[1]The claim of breach of contract was presented out of time. It was reasonably practicable to present the claim in time. The tribunal has no jurisdiction to hear this part of the claim, which is hereby dismissed.[2]The claim of unlawful deduction from wages, including a claim of failure to pay the correct entitlement to holiday pay, was presented out of time. It was not reasonably practicable to present the claim in time. The tribunal has jurisdiction to hear this part of the claim.[3]The respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay to the claimant the gross sum of £807.33.[4]The respondent has failed to pay the claimant’s correct holiday entitlement and is ordered to pay to the claimant the gross sum of £1,032.04.
