JUDGMENT

The judgment of the Tribunal is that: Constructive unfair dismissal(1) The complaint of constructive unfair dismissal is not well founded which means that it is unsuccessful. Unlawful deduction from wages(2) The complaint of unlawful deductions from wages contrary to section 13 Employment Rights Act 1996 is well founded and is successful.(3) In respect of the successful complaint of unlawful deductions from wages, the respondent must pay the claimant the sum of Three Hundred and Forty Pounds (£340.00), representing the deductions made concerning the EV Charger of £200.00 and the sale of a ‘Surface Pro’ of £140.00 Holiday pay(4) The complaint of holiday pay is dismissed upon withdrawal by the claimant.
