JUDGMENT

[1]The claimant’s claim that the respondent made an unlawful deduction from his wages by failing to pay holiday pay is well founded and succeeds. With the consent of the parties the respondent is ordered to pay the claimant compensation in the sum of £794.88.[2]The claimant’s claim that the respondent breached the claimant’s contract of employment by failing to make pension contributions is well founded and succeeds. The respondent is ordered to pay to the claimant compensation in the sum of £180 representing pension contributions at a rate of 2% of gross salary throughout the claimant’s employment with the respondent.[3]The respondent did not provide the claimant with a statement of the main terms of his employment as required by part 1 of the Employment Rights Act 1996. Pursuant to s38 of the Employment Act 2002 the respondent is ordered to pay to the claimant compensation in the sum of £1240, representing four weeks’ gross pay.
