JUDGMENT
The unanimous judgment of the Tribunal is as follows:[1]The complaint of discrimination arising from disability contrary to Section 15 Equality Act 2010 is well-founded. The dismissal of the claimant was in contravention of Section 15.[2]The complaint of a breach of the duty to make reasonable adjustments contrary to Sections 20 and 21 Equality Act 2010 is well-founded. The respondent failed in its duty to make reasonable adjustments by not finding the claimant a part-time indoor role working three hours per day.[3]The complaint of unfair dismissal contrary to Part X Employment Rights Act 1996 is well-founded. The claimant was unfairly dismissed.[4]In respect of injury to feelings under the Equality Act 2010, the Tribunal makes an award of £18,000 together with interest of £2,209.32, making a total award payable by the respondent of £20,209.32.[5]All remaining issues as to remedy are adjourned and will be addressed at a remedy hearing listed on Friday 21 November 2025.
