Employment Tribunals Rules of Procedure 2013 – Rule 21 The time for presenting a response having expired, and no valid response having been presented by the respondent within the prescribed time limit, It is the judgment of the Tribunal that:[1]The respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay the claimant the gross sum of £418.56. The respondent is to pay the gross sum less the appropriate deductions for tax and national insurance, if any, for which he must account to HMRC.[2]The respondent had not complied with s.1 of the Employment Rights Act 1996 by providing the claimant with a written statement of particulars of employment, and the Tribunal, pursuant to s.38 of the Employment Act 2002 , makes an additional award of 4 weeks net pay, £348.00 X 4 = £1392.00, which sum the respondent is also ordered to pay the claimant.
