JUDGMENT
[1]The claimant was a worker within the meaning of section 230(3) Employment Rights Act 1996 “ ERA 1996” from 22 January 2020 until 12 February 2021. The claimant was not an employee as in the meaning of section 230(1) ERA 1996.[2]The claimant is therefore entitled to holiday pay during the period she worked for the respondent. The respondent will make a payment in lieu of four weeks accrued but untaken holidays in the sum of £1,600 to the claimant within 14 days of the date of this Judgment.
