[1]The application to strike out the claim is refused.REASONS
[1]The claimant was ordered to pay a deposit of £250.00 in relation to his complaint of direct age discrimination following a preliminary hearing held on 10 February 2025. The Order was sent to the claimant on 21 February 2025.[2]The date for payment of the deposit was extended to 1 November 2025 by an order dated 20 August 2025. The claimant has failed to pay this deposit. The complaint of direct age discrimination is therefore struck out under rule 40(4) of the Employment Tribunal Procedure Rules 2024.[3]In the same deposit order the claimant was ordered to pay a deposit of £250.00 in relation to his complaint of constructive unfair dismissal. He paid that deposit by the extended deadline of 1 November 2025. By an email to the Tribunal dated 30 October 2025 the claimant confirmed the £250.00 deposit paid related to his constructive dismissal complaint. That complaint will proceed to final hearing.[4]The hearing fixed for 30 March to 2 April 2026 will take place as listed. Approved by
